歡迎使用 NearbyNow。NearbyNow 由 Kadrew J. Lai 提供，本條款中的「本 App」指 NearbyNow，「我們」指 Kadrew J. Lai。註冊或使用本 App，即表示你同意本條款、社群守則和隱私權政策。不同意的話，請不要使用本 App。

本 App 不是報案或緊急求助管道。遇到緊急狀況，請直接撥打 110（警察）或 119（消防、救護），或你所在地區的緊急電話。圖釘上的資訊由使用者提供，可能不完整或不正確。

1. 使用資格與帳號

  • 你必須年滿13歲才能使用本 App；未成年人應取得法定代理人同意。
  • 請提供真實的註冊資料，並保管好你的帳號和密碼。透過你的帳號進行的行為，由你負責。
  • 不得冒用他人身分、買賣或轉讓帳號。

2. 你發佈的內容

  • 你保有你發佈的圖釘、留言、照片和影片的權利。
  • 為了提供服務，你授權我們在全球範圍內免費、非專屬地儲存、複製、顯示、調整格式（例如壓縮照片）及散布這些內容，供本 App 和本網站使用。刪除內容或帳號後，這項授權在合理的處理期間後終止；但已經是公開互動一部分的內容，可能依隱私權政策所述繼續保留。
  • 你必須擁有發佈內容的權利，且內容不得侵害他人權利（包括著作權、肖像權、隱私權）。
  • 內容必須遵守社群守則。
  • 圖釘會在地圖上公開顯示位置，請勿發佈會暴露你或他人住處等私密地點的內容。

3. 內容管理與停權

  • 使用者可以檢舉圖釘和帳號，也可以封鎖其他人；我們可以移除違規的留言。
  • 同一則圖釘被多人檢舉時，會先暫停互動並由我們審核；確認違規的內容會被移除。
  • 違反本條款或社群守則的帳號，可能被凍結（無法發佈、留言、追蹤或傳訊息）或終止。
  • 對處理結果有異議，可以寫信到 [email protected] 申訴。

4. 訂閱與付款

  • NearbyNow Pro 和商家方案是透過 Apple App 內購買的自動續訂訂閱，付款、續訂、取消和退款都依 Apple 的規定處理。
  • 訂閱會在每期結束時自動續訂，除非你在到期前至少 24 小時，到 iPhone「設定 > Apple 帳號 > 訂閱項目」取消。取消後，權益會持續到本期結束。
  • 免費試用結束時，若未先取消，會自動轉為付費訂閱。
  • 訂閱權益以 App 內「NearbyNow Pro」和「商家方案」頁面的說明為準，我們可能調整內容，重大變更會事先公告。
  • 刪除帳號或被撤銷商家認證，不會自動取消 Apple 的訂閱扣款，請自行到上述位置取消；退款請向 Apple 申請。
  • 購買同時受 Apple 的標準授權條款（EULA）規範。

5. 商家與廣告

  • 商家認證需經我們審核，你提供的商家資料必須真實。
  • 商家投放的廣告須經審核後才會上線，並標示「贊助」。廣告內容不得誇大、不實或誤導，也必須遵守社群守則與相關法令。
  • 我們可以拒絕或下架違規的廣告，並可撤銷違規商家的認證。

6. 官方發佈的事件

官方帳號發佈的世界事件，彙整自公開資訊並附上來源，僅供參考，請以各機關的正式公告為準。

7. 免責聲明

  • 本 App 依「現況」提供。使用者發佈的內容不代表我們的立場，我們不保證其正確、完整或即時。
  • 我們不保證本 App 不會中斷或沒有錯誤，也可能因維護、更新或不可抗力暫停服務。
  • 在法律允許的範圍內，對於因使用或無法使用本 App、或因信賴使用者內容所造成的損失，我們不負賠償責任。

8. 條款變更

我們可能修改本條款，並更新頁首的日期；重大變更會在 App 內通知。變更後繼續使用本 App，即表示你同意修改後的條款。

9. 準據法與管轄

本條款以中華民國（台灣）法律為準據法。因本條款所生的爭議，以臺灣臺中地方法院為第一審管轄法院；但法律另有強制規定者，依其規定。

Welcome to NearbyNow (the "App"), provided by Kadrew J. Lai ("we", "us"). By creating an account or using the App you agree to these Terms, the Community Guidelines and the Privacy Policy. If you do not agree, do not use the App.

The App is not an emergency service. In an emergency, call your local emergency number (in Taiwan: 110 for police, 119 for fire and ambulance). Information on pins comes from users and may be incomplete or wrong.

1. Eligibility and accounts

  • You must be at least 13 years old to use the App; minors need the consent of a parent or guardian.
  • Give accurate sign-up information and keep your account and password safe. You are responsible for what happens under your account.
  • Do not impersonate anyone, or sell or transfer your account.

2. Your content

  • You keep the rights to the pins, comments, photos and videos you post.
  • To run the service, you grant us a worldwide, royalty-free, non-exclusive licence to store, copy, display, reformat (for example compress photos) and distribute that content in the App and on this website. The licence ends a reasonable time after you delete the content or your account, except for content that has become part of public interactions and is kept as described in the Privacy Policy.
  • You must have the right to post your content, and it must not infringe anyone's rights (including copyright, likeness and privacy).
  • Content must follow the Community Guidelines.
  • Pins show their location publicly on the map; do not post content that reveals private places such as your or someone else's home.

3. Moderation and suspension

  • Users can report pins and accounts and block other people; we can remove comments that break the rules.
  • When several people report the same pin, interaction is paused while we review it; content found to break the rules is removed.
  • Accounts that break these Terms or the Community Guidelines may be frozen (no posting, commenting, following or messaging) or terminated.
  • To appeal a decision, email [email protected].

4. Subscriptions and payment

  • NearbyNow Pro and the merchant plans are auto-renewing subscriptions bought through Apple in-app purchase; payment, renewal, cancellation and refunds follow Apple's rules.
  • A subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends in iPhone Settings > Apple Account > Subscriptions. After cancelling, benefits last until the end of the current period.
  • A free trial becomes a paid subscription when it ends unless you cancel first.
  • Subscription benefits are as described on the "NearbyNow Pro" and "Merchant plan" screens in the App; we may change them and will announce significant changes in advance.
  • Deleting your account or losing merchant verification does not cancel Apple billing — cancel it yourself as above; request refunds from Apple.
  • Purchases are also governed by Apple's Standard End User License Agreement.

5. Merchants and ads

  • Merchant verification is reviewed by us; the business details you provide must be true.
  • Merchant ads go live only after review and are labelled "Sponsored". They must not be exaggerated, false or misleading, and must follow the Community Guidelines and applicable law.
  • We may reject or remove ads that break the rules and revoke the verification of merchants who do.

6. Events published by the official account

World events posted by the official account are compiled from public sources, with the source linked, for information only. Please rely on official announcements from the relevant authorities.

7. Disclaimers

  • The App is provided "as is". Content posted by users does not represent our views, and we do not guarantee it is accurate, complete or current.
  • We do not guarantee that the App will be uninterrupted or error-free, and it may be suspended for maintenance, updates or reasons beyond our control.
  • To the extent permitted by law, we are not liable for losses arising from using or being unable to use the App, or from relying on user content.

8. Changes to these Terms

We may change these Terms and will update the date at the top; significant changes are announced in the App. Continuing to use the App after a change means you accept the updated Terms.

9. Governing law

These Terms are governed by the laws of the Republic of China (Taiwan). The Taiwan Taichung District Court has jurisdiction in the first instance over disputes arising from them, unless mandatory law provides otherwise.
